Summary:        The Petitioner filed a motion under 28 U.S.C. § 2241 for habeas corpus relief. The Court reviewed the motion and concluded that the motion should be reclassified as a 28 U.S.C. § 2255 motion. Pursuant to Morales v. United States, 304 F.3d 764 (8th Cir. 2002), the Court, prior to reclassifying the motion, informed the Petitioner of the restrictions on second or successive Section 2255 motions and of the one-year limitation period on filing Section 2255 motions. Additionally, the Court provided the Petitioner an opportunity to either consent to the reclassification or to withdraw the Section 2241 motion.
