Summary:       The Plaintiff filed a motion for summary judgment, contending that the Tribal Court lacks subject-matter jurisdiction over the dispute because the Plaintiff is a nonmember of the Tribe. The Court, applying the rule first articulated in Montana v. United States, 450 U.S. 544 (1981), concluded that the first Montana exception applied and that the Tribal Court has not exceeded its jurisdiction by exercising authority over the Plaintiff. The Court denied the motion and sua sponte granted summary judgment in favor of the Defendants.
